3.1 Where the Australian Consumer Law, Schedule 2 of the Competition and Consumer Act 2010, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

4. Limitation of Liability
4.1 The Platform and Service owners, directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Service or Platform.

5. Indemnity
5.1 Users of our Service and Platform hereby agrees to indemnify, defend, and hold harmless KHR Insolvency, its affiliates, officers, directors, employees, agents, and representatives (‘Indemnified Parties’) from any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that such Indemnified Parties may incur as a result of or arising from the Client’s use, misuse, or reliance upon the advice, recommendations, or services provided by KHR Insolvency. This indemnification obligation will survive the termination or conclusion of services provided by KHR Insolvency. Notwithstanding the foregoing, the Client shall not be required to indemnify KHR Insolvency for any liability arising from KHR Insolvency’s own fraudulent acts, wilful misconduct or gross negligence.

5.2 In certain circumstances, KHR Insolvency may provide creditors with access to documents containing reports to creditors, concerning various insolvent entities via our website. We make reasonable efforts to safeguard this information through security measures, including password protection. Creditors accessing this information give an obligation that they will not disclose any information provided on our website. However, we cannot offer absolute assurances concerning the security of such information after it has been accessed by third parties, and therefore cannot accept liability for any security breaches that may occur.

6. Applicable Law
6.1 These Terms and Conditions are governed by the laws of the State of New South Wales.

7. Dispute Resolution
7.1 Subject to any exceptions specified in these Terms and Conditions and our Complaints Handling Policy, if you and KHR Insolvency are unable to resolve any dispute through informal discussion, then you agree to submit the issue first before a non-binding mediator and to an arbitrator in the event that mediation fails. The decision of the arbitrator will be final and binding. Any mediator or arbitrator must be a neutral party acceptable to both parties. The costs of any mediation or arbitration will be shared equally between the parties.

7.2 Notwithstanding any other provision in these Terms and Conditions, you agree that you retain the right to bring an action in small claims court and to bring an action for injunctive relief or intellectual property infringement.

8. Severability
8.1 If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

9. Changes
9.1 These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Platform and the way we expect users to behave on our Site.
